This matter involved a proposal to construct two high quality, spacious homes in the bayside suburb of Altona. The land was located within walking distance of the bay.

Council refused to grant a planning permit on amenity and character grounds. It also opposed the design of the basement car parking. Prior to the hearing, the Council also raised concerns over the possible impact or climate change on sea levels.

The landowners engaged Glossop Town Planning to represent them at VCAT. We also engaged expert evidence on coastal hazard flooding vulnerability.

VCAT overturned the Council’s decision and directed it to grant a planning permit.
